On Monday, November 10, 2003, the Registrant issued a Press Release, attached hereto as an exhibit, stating that it has reviewed the Surface Transportation Board's ruling in Duke Energy Corp. v. Norfolk Southern Railway Company and has concluded that the impact of the decision on earnings cannot be determined at this time.
