Moreover, the founder of Law Offices of Francis King pointed out that, in Tennessee, parties are required to attend and complete mediation as a prerequisite before a divorce case goes to trial. King explained, “The process is entirely confidential and off the record. The court will never know what anyone offered or said at mediation. The only information the judge receives is a one-sentence report form the mediator indicating either that the case was settled or it was not.”
King stated, further, that the mediator will be an experienced family law attorney who has special training per Rule 31 of the Tennessee Supreme Court, and that the process is designed to allow each party and his/her attorney to talk with the mediator alone and confidentially, which enables the mediator to fully understand where each spouse is coming from.
“Tennessee law says you have to try to settle your divorce case at mediation, but it doesn’t say when,” King said. “This means that you can do it early in the divorce process or wait until the eve of trial, or do it somewhere in between. I try to get my clients to mediation sooner rather than later whenever possible. The only thing worse than a bad marriage is a long, expensive divorce case. Mediation can provide an early exit opportunity that saves everyone a lot of money and aggravation.”
