Engaging with an independent contractor directly

There has been significant media coverage recently about an Australian business that was impacted by a ruling in their specific case of an offshore contract being afforded the same employment rights as a locally based employee.

The general guidance is to seek your own advice for your business when assessing the level of risk though if you do want to avoid encountering any potential problems in future then engaging with your contractor via the appropriate channels would be appropriate.

When reviewing a potential outsourcing partner its important to consider some of the following items:

  1. Are your contractor’s tax obligations and other government contributions being fulfilled?

  2. What level of support is your contractor afforded?

  3. What are the advantages of engaging with a contractor via an outsourcing partner vs directly?
